UGA-FORSALE Guidelines

GUILDELINES FOR THE UGA-FORSALE LISTSERV

UGA-FORSALE is distributed, at considerable expense, by the University's computers and computer networks. This is true even if you are accessing it from home. It is a privilege for University employees and is subject to all the restrictions on acceptable use of UGA computers (www.uga.edu/compsec) and to compliance with these guidelines. Subscribers MUST BE employees of the University of Georgia System. Subscribing under an email outside of the UGA system is not allowed. UGA-FORSALE is limited to 50 postings a day.

Failure to comply with guidelines will result in an immediate one-month suspension. Subsequent violation will cause loss of subscription privileges for a minimum of six months; repeated offenses will result in permanent loss of privileges.

NOTE: Subscribers MUST HAVE their REAL NAME associated with their UNIVERSITY OF GEORGIA SYSTEM EMAIL address in order for their post to be released by the moderator. Emails coming from gmail or any other accounts not associated with an University of Georgia SYSTEM email address will NOT be released to this list. Simply put, emails MUST be from UNIVERSITY OF GEORGIA SYSTEM addresses in order to be released by the moderators to the UGA-Forsale List.

ONLY PERSONALLY OWNED ITEMS can be posted for sale. (Please also see "Business Activity Definition" below before posting an item.)

1. The item(s) the subscriber is seeking or selling must be a tangible object, (you may need patience, but you can NOT buy or sell it here) :) Niether can contracts nor plans be sold here, this includes but is not limited to cell phone contracts or plans with various carriers. A cell phone can be sold here, but not a contract. If you wish to trade or have someone take over a contract you are welcome to use the STAFF listserv.

2. The SUBJECT LINE of ANY post to the UGA FORSALE listserv MUST be worded as the following:
FS: (state the item you are selling)
WTB: (state the item you are looking to purchase or want)
FREE: (state the item you are giving away)
Looking for: (ONLY USE *Looking for* when trying to find coupons)
In need of: (IS NOT ALLOWED. This is a FOR Sale list, *in need of* suggestion you are looking for someone to GIVE you something. This list is for subscribers who wish to Sell or Buy.)
Subscribers are NOT allowed to TRADE/BARTER on this list or solicit TRADES on this list.

3. Do NOT post items for a friend or relative. This listserv is only for University System employees.

4. Subscribers are limited to two postings in a 24 hour period.

5. Each item should only be posted ONCE (and no more than 2 times to the list regardless if it sells or not). If it is posted a second time the price must be reduced, or the circumstances change, or correction of a genuine mistake made with the first post, or an agreed-upon sale fell through.

6. Each item posted must have a stated price or dollar amount you wish to spend for an item. Clarification on OBO (or best offers): OBO is NOT ALLOWED. OBO leaves room for subscribers to use the UGA email system to drive up the price of an item, which would be considered abuse.

7. Posting a personal vehicle for sale is acceptable.

8. Posting a personal residence or dwelling for sale is acceptable.

PICTURES of items *for sale* or *want to buy*

Postings can include pictures of the items for sale as long as they meet the format criteria of 320 pixels x 240 pixels or smaller.
Posting a URL (website address) which displays a similar or actual picture of the item for sale is allowed as long as the site is a UGA myweb page (instructions can be found at (http://www.eits.uga.edu/myweb/) or a photo-sharing web site.
Posting a URL which is your personal business activity site, such as yournamedomain.com, yournamedomain.net, or yournamedomain.org, is NOT allowed

ADULT ENTERTAINMENT

Posting (FS or WTB) movies with X ratings or other material with primarily pornographic or sexual content is NOT allowed. Even if the material itself is legal, distributing the ads could be construed as sexual harassment in the workplace.

Advertising

Postings that advertise businesses or services are NOT allowed.

ANIMALS

Posting animals FOR SALE or WANTING to BUY is NOT allowed. The reason is that we cannot tell whether you are breeding the animals for sale, which would be a business activity.
Posting of animals for adoption is acceptable and the posting MUST state in the SUBJECT LINE the animal is FREE.

BUSINESS ACTIVITY DEFINITION

By law, the State of Georgia cannot provide free advertising for private money-making ventures; therefore, posting what would be considered a business activity is NOT allowed. This includes, but is not limited to, items that you buy, make, or grow for resale, such as cosmetics, firewood, crafts, garden produce, hay, grasses, or plants. You also cannot advertise services such as typing, sewing, handy-man services, cooking, and the like.
State law states employees cannot use University's computers for BUSINESS ventures, REGARDLESS of whether they actually make money. This includes items you buy with the intention to resell.

CONTRACTS/PLANS

Selling contracts or plans, such as, phone plans or any other legal contract between the seller and a vendor is NOT allowed on this list. A contract or a plan is viewed as a legal binding document between the seller and the vendor therefore it is NOT tangible object which can be sold.

COUNTERFEIT OR KNOCK-OFF MERCHANDISE

It is illegal to sell Counterfeit or Knock-off merchandise in the State of Georgia. Misleading transmittal of names or selling items using FAKE trademarks on an item (falsely identifying yourself or falsely claiming to speak for a person or organization by using their name, trademark, logo, or seal, Ga. Code 16-9-93.1) is NOT allowed.

COUPONS

SELLING coupons or TRADING coupons is NOT Allowed.
GIVING away coupons or LOOK FOR coupons is allowed.
SELLING gift certificates in NOT Allowed.
GIVING away gift certificates is allowed.
SELLING gift cards is allowed but selling price must be less than the redeemable amount.

FIREARMS, WEAPONS, AND EXPLOSIVES

It is a FELONY to bring weapons on campus. (http://www.police.uga.edu/documents/uga_weapons_policy.pdf). To prevent inadvertent violations of this law, the list administrators have voted to disallow the sale of weapons on this list.

FUNDRAISING and/or COMMUNITY NEEDS

Fundraising is NOT ALLOWED on the UGA FORSALE list by any organization, even when an individual UGA employee is raising money for them. Accordingly, this is not the place to sell coupon books, candy, or other fundraising items for organizations inside or outside the University. ***HOWEVER, subscribers may post FUNDRAISING events and efforts to the UGASTAFF listserv because of its broader community nature.***
Subscribers who are in need of shared leave need to contact Human Resources Department at UGA to find out the proper procedure for this. Asking for shared leave time on this list is NOT ALLOWED.

HANDMADE or NATURE MADE ITEMS (please see Business Activity Definition)

Selling handmade or nature made items is NOT allowed on this list. Bartering handmade or nature made items is NOT allowed on this list as it could be viewed as advertising. Postings where the subscribers wants to buy handmade or nature made items is ALLOWED.

For example: A posting which states WANT TO BUY pecans which are shelled is ALLOWED.
For example: A posting which states FS: Handmade skirts, one size fits all, for $X is NOT ALLOWED.

Items which can NOT be SOLD or BARTERED on this list include, but is not limited to, items that you buy, make, harvest, or cultivate/grow for SALE or RESALE, such as firewood, garden produce, hay, pinestraw, grasses, eggs, honey, or plants. This would also include cosmetics or handmade jewelry, handmade crafts, handmade items of clothing or accessories, and handmade furniture.

RENTALS/SUBLEASES/REAL ESTATE

Posting a personal residence or dwelling for sale is acceptable.
Postings FOR RENT of real estate which the subscribers OWNS is NOT ALLOWED and would be considered as the subscriber using this list for adverstising for rental income.
Postings of subleases of rental property, PROVIDED THAT YOU DO NOT OWN THE PROPERTY, that you personally are occupying may be offered but must be stated as such, and should include when the property will be vacated and when the lease is up.
Postings by a subscriber who wants to rent a property to occupy is acceptable.
Postings by a subscriber wanting to rent a piece of equipment or item is acceptable.
Posting by a subscriber who is SEEKING a roommate and the subscriber does NOT own the property is ALLOWED.
Posting by a subscriber who is SEEKING a roommate and the subscriber does OWN the property is NOT allowed.
Posting timeshares for sale is acceptable, posting timeshares for rent is NOT acceptable.

RECOMMENDATIONS

Postings asking for recommendations are NOT allowed on UGA-FORSALE, but may be posted on the UGASTAFF discussion listserv.

For example: If you are in need of a doctor and you want feedback from the list, then you would post to the UGASTAFF list because your question is more of a discussion, not selling or buying.

Postings seeking domestic service/employment are allowed; the posting MUST clearly state the description of the job and the pay rate. The posting must also be in compliance with UGA's Non-discrimination Anti-harassment Policy listed at http://askuga.uga.edu/default.asp?id=964&Lang=1&SID.

For example: A posting which states Need yard person for the summer in Winterville area, willing to pay $20 per hour, Phone 222- 444-1234 if interested is allowed because you are seeking to employ someone for a job and have listed the pay rate.

TICKETS

Posting tickets for sale to local events is acceptable as long as you are selling tickets you originally bought for your own use and are reselling for the same price that you paid or less.
Posts seeking to buy or sell tickets to ALL UGA sports events are NOT allowed; instead, employees should use the UGA-Tickets listserv. Guidelines are at http://suesmith.myweb.uga.edu/uga-tickets.html.

YARD SALES OR ESTATE SALES

Subscribers can post THEIR yard sale or estate sale.
Subscribers can NOT post yard sales for organizations, as it is seen as FUNDRAISING. Subscribers are welcome to post yard sales which benefit other organizations to the UGA STAFF list.

ALTERNATIVES TO UGA-FORSALE are the less-restrictive yahoo group at http://groups.yahoo.com/group/uga-for-sale/ or running a classified ad (presently four lines for items under $500 are free) in the Athens Banner Herald.

If you are unsure whether a post you wish to make is appropriate, please contact a list administrator at 4sale@uga.edu and ask before posting.

These are guidelines set by the University and by the list owners. The administrators of this list are UGA employees and will enforce these guidelines set by their community. As a subscriber, failure to comply with these guidelines will result in an immediate one-month suspension.
